# Terms & Conditions

> The terms that govern access to and use of the Kriyah platform, including subscriptions, the free trial, acceptable use, data, AI outputs and liability.

## 1. Definitions

- **Platform or Service:** The Kriyah software-as-a-service product, including the Creator Portal.
- **User or Client:** The business customers, brands and agencies who access or use the Service.
- **Creator:** A content creator who takes part in a collaboration through a Creator Portal link.
- **Subscription:** The monthly, half-yearly or yearly plan that gives access to the Service.
- **Content:** Data, information and other material a User provides on the Service.

## 2. Acceptance of terms

By accessing or using the Service, you agree to these terms. If you use the Service for an organisation, you confirm you have authority to accept these terms for it.

## 3. Accounts

Keep your login details confidential and tell us promptly about any unauthorised use. You are responsible for activity under your account and for the users you invite.

## 4. Subscriptions and payment

- The Service is available on monthly, half-yearly and yearly subscriptions, as described on the [pricing page](https://kriyah.ai/pricing/).
- Prices are in US dollars unless agreed otherwise in writing. Applicable taxes are added.
- You agree to pay all fees for your chosen plan. Payments are non-refundable except as required by law or stated in these terms.
- Report credits and tracked posts are available for the subscription term, as set out in your plan.

## 5. Free trial

- We may offer a free trial, currently 7 days with the allowances shown on the pricing page. No payment is required to start.
- Granting a trial is at Kriyah's discretion, and a trial can be ended or limited at any time without notice.
- When a trial ends, access stops unless you subscribe to a paid plan.

## 6. Services and acceptable use

Kriyah helps you find creators, run campaigns and measure results. The platform does not guarantee campaign success or specific outcomes.

You must not:

- Use the Service for anything illegal or unauthorised
- Resell, scrape or bulk-export creator data except through the platform's export features
- Send creators unsolicited or misleading messages through the Service
- Break the terms of the social platforms involved, such as Instagram, TikTok and YouTube, or the advertising and disclosure rules that apply to sponsored content

A breach of this section can lead to immediate suspension or termination.

## 7. Creator collaborations

Collaborations run through the Creator Portal are between the brand or agency and the Creator. Kriyah provides the tools and is not a party to those agreements. Kriyah records payments and shipments that you update but does not process payments or carry goods.

## 8. Data, estimates and AI outputs

- Your data is stored and processed under our [Privacy Policy](https://kriyah.ai/privacy/).
- Kriyah may analyse and use aggregated, anonymised data for research and development.
- Some figures, such as estimated reach, fair price ranges and earned media value, are estimates and are labelled as such.
- AI-generated drafts and recommendations should be reviewed before you rely on them.

## 9. Intellectual property

Kriyah owns the Service, its software and its content. You own your Content and give Kriyah a licence to host and process it to provide the Service.

## 10. Termination and access

- Kriyah may cancel a Subscription and deny access if a User breaks these terms.
- Either party may end the Service with prior notice. After termination, you will no longer have access to the Service.

## 11. Warranties and disclaimers

- The Service is provided "as is".
- Kriyah makes no warranties about the accuracy or completeness of any Content or about the results of using the Service.

## 12. Limitation of liability

Kriyah, its employees and affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits or revenue.

## 13. Indemnification

You agree to indemnify and hold harmless Kriyah, its employees and affiliates against any third-party claim arising from your breach of these terms or of any law.

## 14. Governing law and jurisdiction

These terms are governed by the laws of India. Disputes arising from them are subject to the exclusive jurisdiction of the courts in Hyderabad, India.

## 15. Changes to these terms

Kriyah may change these terms. We will update the date at the top, and continued use of the Service means you accept the updated terms.
